CONTRACTOR AGREEMENT

Autumn 2022

This contract will serve as the basis for all tutoring arrangements between us, Acadia Learning (AL) and you (the tutor). The following arrangements are understood and agreed by AL and you in connection with any tutoring agreement you enter into, following an introduction to the client (student or parent/guardian) by us.

You have read and agreed to the terms and conditions and safeguarding policy set out by AL and will abide by them.

Please note that it is completely unacceptable to take any work for yourself that has been generated by Acadia Learning. There is absolutely no doubt that customers will ask you if they can see you privately and to ‘cut out the middle man’.

So…

- if anyone asks you to tutor without our being involved. The answer has to be NO

- if someone wants to introduces you to a new pupil or parent, the answer is NO it has to go through Arcadia

- if a parent wants another subject that you can’t provide, you don’t give them someone else’s name, you refer them back to us. 

- if you have any doubts at all, please simply let us know straight away and we will deal with the matter, and try to get everyone in the Arcadia team as much work as possible.

We are very sorry to say, that if anyone breaks these rules above, we will have to stop working with straight away for the benefit of the whole team.

Status

You will be an independent contractor and therefore not an employee, worker or partner of AL. You will be liable for any taxation arising from these services (see full details in Terms and Conditions).

You will also be liable for any liability, assessment or claim brought in connection with the provision of services (see full details in Terms and Conditions).

Remuneration

All fees will be agreed prior to committing to a tutoring job. At the end of each month it is the responsibility of you to submit an invoice with detailed information to include child’s name, dates and hours worked. You must not accept any payment from a client, nor enter into any discussion regarding rates, refer such discussions directly to us. (see full details in Terms and Conditions)

AL will then confirm receipt and acceptance of the charges and arrange payment within 5 working days.

Reporting

You commit to complete reports to the level expected by parents: in timely fashion, accurate and in a positive manner.

Facilities/Equipment

Tutors are expected to provide their own lesson plans, reports etc, and use personal software for online tutoring.

Confidentiality

You shall not use or disclose to any person, either during or at any time after the period of your agreement with the Company, any confidential information about the business or affairs of the Company or any of its business contacts, or about any other matters which may come to your knowledge in the course of providing the Services, including payment rates, terms and other arrangements. For the purposes of this clause, confidential information means any information or matter which is not in the public domain and which relates to the affairs of the Company or any of its business contacts.

Child Safeguarding Policy & DBS Checks

Although tutors are not legally required to undergo DBS checks it is in your best interest to do so. If you do not have a current DBS Check and wish to apply, you can apply to obtain a DBS check here.

Insurance

As a self-employed tutor you are not covered by AL’s insurance. For help and advice on arranging your insurance you can contact the Tutors’ Association.

Termination

The Company may at any time terminate this agreement with immediate effect with no liability to make any further payment to you (other than in respect of any accrued fees or expenses at the date of termination) if:

(a) you are in material breach of any of your obligations under the Terms and Conditions, Safeguarding Policy or this agreement or;

(b) other than as a result of illness or accident, after notice in writing, you wilfully neglect to provide, or fail to remedy any default in providing the Services.

Any delay by AL in exercising its rights to terminate shall not constitute a waiver thereof.

Restrictions

You shall not, prior to termination of this contract or for 12 months following, directly or indirectly approach, canvass, solicit or endeavour to entice the custom of any person who is a customer of FT (student or parent/guardian) (see full details in Terms and Conditions).
